Separation by mutual consent

This is when both spouses agree on the separation. Both spouses may petition for this type of separation, or one can petition with the consent of the other. A settlement must accompany the petition in which the spouses should agree on the care and custody of their children, the visitation arrangements, child support and maintenance payments and, if applicable, the use of the family home etc. The legal procedure is quick and simple.
